    Help! Re-encodes in wrong layer??

I have used version 9 and now i am trying version 11.5.
With both I have the same weird problem:

When I re-encode mp3 files sometimes randomly (not everytime, but say 1 out of 5) ends up as mpeg layer 1 or 2.
It's not the source mp3, because sometimes, when I re-re-encode it ands up as mpeg layer 3 (mp3) (or anything else. I've seen the strangest things show up).

What's wrong here? I (want to) batch-re-encode to 128k/44.1 with lame.

What is telling you the layer? what layer does it say if you hold the mouse over the file? what frequency are those files?
