CBR to VBR conversion results in bitrate increase

I was curious as to why a 96 bitrate encoded mp3 file would result in higher bitrates when converted to vbr even if minimum bitrates are set below 96. if something is not there its not there :D thanks to anyone who can shed light on this question

Because VBR senses the increase in data in a certain part and increases the bitrate. It doesn't know that 96kbps is as high as the file is, it just knows that segment deserves an increase in bitrate.
