apple lossless->MP3 overwritten songs when song played twice

Hi, Sorry if this has been answered, don't see it if so.

When I do a large batch conversion from apple lossless (using reference) to MP3 I have many sets of live music where the same named song is played twice at a given show (yes GD). The two segments of the same song do have different track numbers in the metadata but the first version get overwritten by the second instance (or latter portion) of the song. So I end up losing part of the show post conversion.

Is there a fix?

Note this does not happen with the original flac->apple lossless conversion.

Use dynamic naming and put the track number in the filename.

Is this an issue with the LAME encoder given it works fine in other formats?
