Cannot use CBR rate with MP3 encoder

I keep getting errors like the one below when I try to use CBR (constant bit rate)... I like to do this for audiobooks etc. like 32kb etc... but now I get this.

This is only a problem wiht R12, it works fine with 11.5 and it's lame encoder. Any help is appreciated.
